Grounds for Divorce:
A breakdown of the marriage is the most common reason for divorce in Canada, and it is based on one of the following three grounds:
- Separation of at least one year: This requires that the spouses have been living apart from each other for a minimum of one year prior to filing for divorce. Although the application for divorce can be submitted at any time, the court will not grant the divorce until one full year of separation has been achieved.
- Adultery: This means that one spouse has engaged in sexual intercourse with someone else other than their spouse.
- Cruelty: This means that one spouse has subjected the other to physical or mental cruelty of such a nature that it is no longer possible for them to live together.
