Spousal Support

Spousal support, is a form of financial assistance provided by one spouse to theĀ other after a separation or divorce. The purpose of spousal support is to help the recipient spouse maintain a standard of living that is similar to the one they had during the marriage.

Section 30 of the Family Law Act dictates that each spouse must offer support to the other based on their necessities, given that they possess the capability to do so.

There are several reasons why someone may need spousal support, including but not limited to:

  • To provide for basic needs such as food, shelter, and clothing
  • To compensate for a difference in earning capacity between the two spouses
  • To cover for the ongoing care of children in addition to any child support responsibilities
  • To maintain a standard of living that was established during the marriage
  • To provide financial support while the recipient spouse adjusts to living on their own

In general, spousal support is awarded based on several factors, including the length of the marriage, the age and health of both parties, the financial resources of each spouse, the earning capacity of each spouse, and which spouse has custody of the children. It is important to keep in mind that every case is unique and the outcome may vary depending on the specific circumstances of each case.
